Terms of service

Last updated: 27/10/2026

Who we are and who these terms apply to

ARCO™ is a subscription software service of Future Tech & Wisdom S.R.L., VAT no. 03833730835, certified email (PEC) ftwonweb@namirialpec.it, with registered office at Viale della Libertà 271, 98121 Messina, Italy.

These terms govern the use of ARCO™ by the customer, that is the business or professional who activates a subscription. The service is intended only for those acting within their business or professional activity: consumer protection rules do not apply.

Conclusion of the contract

The contract is concluded when the customer completes the purchase on Stripe and accepts these terms in the activation form. Each module (STUDIO, INVENTARIO, QUOTA, CODA) is a separate subscription, with the plan and price shown at the time of purchase.

Free trial, prices and payments

  • the free trial, where offered, lasts the number of days shown on the pricing page; at the end the subscription continues as a paid one, unless cancelled before it expires;
  • prices are those on the pricing page at the time of purchase, excluding VAT;
  • payments are handled by Stripe as a recurring charge, according to the period of the chosen plan;
  • the Grow plan includes the support and development hours shown on the pricing page, to be used within the reference month.

Cancellation and plan changes

The customer can cancel or change plan at any time from the account area. Cancellation takes effect at the end of the period already paid and gives no right to a refund for the current period. The customer can also delete the organization from the account area: the data stays recoverable for 30 days and is then deleted for good.

Accounts and proper use

  • the customer keeps its users' credentials safe and is responsible for what they do in the service;
  • the customer uses ARCO™ in compliance with the law and does not try to bypass its security, decompile it or resell it to third parties;
  • the customer is responsible for the data it enters and for having, towards its own clients, patients or staff, an appropriate legal basis and privacy notice.

Availability and support

We work to keep ARCO™ available and secure, but we do not guarantee an uninterrupted service: maintenance may be needed, usually announced in advance, and outages of external providers may occur. Support can be requested at hello@ftwonweb.com.

Artificial intelligence in QUOTA

In QUOTA, quotes and bills of quantities are generated with the help of Claude, Anthropic's artificial intelligence service. They are proposals to be checked: before using or sending them, the customer verifies quantities, prices and content, and remains responsible for them.

Liability

Except in case of wilful misconduct or gross negligence, our liability towards the customer is limited to the amount paid for the service in the 12 months before the event and excludes indirect damages, such as loss of profit or loss of data not caused by our fault.

Changes to these terms

We may update these terms by notifying the customer by email at least 30 days in advance. If it does not accept them, the customer can cancel before they take effect; otherwise they apply from the stated date.

Governing law and jurisdiction

The contract is governed by Italian law. The court of Messina has exclusive jurisdiction over any dispute.

Annex: data processing agreement (art. 28 GDPR)

For the personal data the customer enters in the modules, the customer is the controller and Future Tech & Wisdom S.R.L. is the processor. This annex is the contract required by art. 28 of Regulation (EU) 2016/679 (GDPR) and applies for the whole duration of the subscription.

Subject matter, nature and purpose

We process the data only to provide the service chosen by the customer: storing it, showing it to its users, processing it with the module's features and, in QUOTA, sending it to Anthropic to generate quotes and bills of quantities. We do not use it for any other purpose.

Data and data subjects

  • data subjects: the customer's clients, patients and suppliers, and its staff who use the service;
  • data: personal and contact details, appointments, messages and notes, stock movements, queues, documents and quotes;
  • STUDIO may contain health data (art. 9 GDPR): the customer enters it only if needed and if it has a legal basis for it.

Processor obligations

  • we process the data only on the customer's documented instructions, that is these terms and the way it uses the service, and we inform it if an instruction appears to breach the law;
  • the people authorized to access the data are bound by confidentiality;
  • we take appropriate security measures (art. 32 GDPR): encrypted connections, passwords stored only in encrypted form, each customer's data kept separate from the others', access limited to those who need it;
  • we help the customer answer data subjects' requests and meet the obligations of articles 32–36 GDPR;
  • we notify the customer of any personal data breach without undue delay after becoming aware of it, with the information it needs for its own notification;
  • we make available the information needed to demonstrate compliance with this annex and allow audits, including by an auditor appointed by the customer, with reasonable notice.

Subprocessors

The customer authorizes us to use these subprocessors, bound by the same data protection obligations:

  • Hostinger International Ltd (Cyprus): hosting of servers and databases, in Germany (Frankfurt);
  • Anthropic: artificial intelligence processing of QUOTA documents, with standard contractual clauses for transfers outside the European Economic Area; it deletes the data within 30 days and does not use it to train its models.

Changes to subprocessors

We notify the customer by email at least 30 days before adding or replacing a subprocessor. If it has data protection grounds to object, the customer can cancel the service before the change.

End of processing

When the contract ends, or when the customer deletes the organization, the data stays recoverable for 30 days and is then deleted for good, except what the law requires us to keep. Before deletion the customer can ask for a copy of its data in a commonly used format at privacy@ftwonweb.com.
